KENDALL AND KYLIE PULL T-SHIRT FROM PACSUN FOLLOWING LAWSUIT
Kendall and Kylie Jenner are most well-known for being little sisters of Kim Kardashian but they've also been quit busy modeling, novel-writing and designing fashion collections for Topshop and PacSun. The duo recently settled a lawsuit involving a t-shirt from their PacSun collection. As part of the settlement, the retailer has agreed to pull the infringing t-shirt from its shelves.
Island Company filed suit against the sisters and PacSun in October 2015 alleging the t-shirt designed infringed on the company's trademarked logo. Island Company's slogan is "Quit Your Job. Buy a Ticket. Get a Tan. Fall in Love. Never Return." The infringing t-shirt reads, "Run Away. Fall in Love. Never Return." Island Company alleged that the infringing t-shirt was "likely to cause confusion, mistake and deception among consumers, the public and the trade among consumers, the public and the trade as to whether defendants’ products or services are affiliated with, sponsored by or endorsed by plaintiff."
It seems imitation is not the sincerest form of flattery for Island Company.
